Welcome to Coffee Trial, operated by TastePilot LLC. These Terms of Service ("Terms") are a legally binding contract between you and TastePilot LLC regarding your use of our website at coffeetrial.com and all related services.
BY CLICKING "I ACCEPT," OR BY DOWNLOADING, INSTALLING, OR OTHERWISE ACCESSING OR USING THE SERVICE, YOU AGREE THAT YOU HAVE READ AND UNDERSTOOD, AND AGREE TO BE BOUND BY, THESE TERMS AND CONDITIONS, INCLUDING OUR PRIVACY POLICY, SUBSCRIPTION AND CANCELLATION POLICY, RETURN AND REFUND POLICY, AND ALL OTHER POLICIES REFERENCED HEREIN (COLLECTIVELY, THESE "TERMS").
IF YOU DO NOT AGREE TO THESE TERMS, YOU DO NOT HAVE OUR PERMISSION TO USE THE SERVICE.
ARBITRATION NOTICE: Except for certain kinds of disputes described in Section 17, you agree that disputes arising under these Terms will be resolved by binding, individual arbitration, and BY ACCEPTING THESE TERMS, YOU AND TASTEPILOT LLC ARE EACH WAIVING THE RIGHT TO A TRIAL BY JURY OR TO PARTICIPATE IN ANY CLASS ACTION OR REPRESENTATIVE PROCEEDING. YOU AGREE TO GIVE UP YOUR RIGHT TO GO TO COURT to assert or defend your rights under this contract (except for matters that may be taken to small claims court). Your rights will be determined by a NEUTRAL ARBITRATOR and NOT a judge or jury. (See Section 17.)
1. Service Overview
Coffee Trial, operated by TastePilot LLC (doing business as Coffeetrial.com LLC), offers premium coffee subscriptions, wholesale coffee sales, and curated coffee products from specialty roasters worldwide ("Products"). Our Service includes:
- Personalized coffee subscriptions with flexible delivery schedules
- Wholesale coffee programs for businesses
- Single-purchase specialty coffee options
- Coffee accessories and brewing equipment
- Educational content and brewing guides
- Customer support and coffee consultation services
2. Definitions
For purposes of these Terms:
- "Company," "TastePilot LLC," "Coffee Trial," "we," "us," or "our" refers to TastePilot LLC, a New Mexico limited liability company doing business as Coffeetrial.com LLC.
- "Service" means our website at coffeetrial.com, mobile applications, and all related services, features, and content we provide.
- "Products" means all coffee, merchandise, and other items available for purchase through our Service.
- "User," "you," or "your" refers to any individual or entity accessing or using our Service.
- "Subscription" means a recurring delivery arrangement for Products.
- "Content" means all text, images, videos, and other materials available through the Service.
3. Eligibility
You must be at least 18 years old to use the Service. By agreeing to these Terms, you represent and warrant that:
- You are at least 18 years old;
- You have not previously been suspended or removed from the Service;
- Your registration and use of the Service complies with all applicable laws and regulations;
- If you are an entity, the individual accepting these Terms has authority to bind the entity to these Terms.
4. Accounts and Registration
To access certain features of the Service, you must register for an account. When registering, you agree to:
- Provide accurate, current, and complete information;
- Maintain and promptly update your account information;
- Maintain the confidentiality of your account credentials;
- Accept responsibility for all activities under your account;
- Immediately notify us at hello@coffeetrial.com if you suspect unauthorized access to your account.
We reserve the right to suspend or terminate accounts that violate these Terms or for any other reason at our discretion.
5. Payment Terms
5.1 General Payment Terms
Certain features of the Service require payment. All fees are in U.S. Dollars and are non-refundable except as expressly stated in our Return and Refund Policy.
5.2 Pricing
We reserve the right to determine and modify pricing for Products and Services. We will make reasonable efforts to keep pricing information current on our website. We may change fees with advance notice. Promotional offers are subject to their specific terms and may not apply to all customers.
5.3 Payment Authorization
You authorize us to charge all amounts due for your orders and subscriptions to your designated payment method, including all applicable taxes. We may seek pre-authorization of credit card accounts to verify validity and available funds.
5.4 Product Orders
Your order constitutes an offer to purchase Products, subject to our acceptance. We may accept, decline, or limit orders for any reason. By clicking "Purchase," "Buy," or similar buttons, you enter into an obligation to pay. If we reject your order, we will refund any payment received.
5.5 Subscription Service
Automatic Renewal: Subscriptions automatically renew until cancelled. You authorize recurring charges to your payment method.
Billing Schedule: Subscription charges occur on your selected billing cycle (weekly, bi-weekly, or monthly). The billing date is typically 2-3 business days before shipment.
Cancellation: You must cancel before 1 PM PST on Wednesday the week before your next scheduled shipment to avoid the next charge. Cancel through your account dashboard or by contacting hello@coffeetrial.com.
Modifications: You may modify your subscription preferences, including coffee type, quantity, and frequency, through your account dashboard.
5.6 Wholesale Orders
Wholesale orders are subject to approval, minimum order quantities, and may have different payment terms. Contact us for wholesale pricing and terms.
5.7 Delinquent Accounts
We may suspend or terminate access to the Service for accounts with unpaid amounts. Delinquent accounts may incur collection fees and charges.
6. Shipping and Delivery
6.1 Shipping Locations
We ship to all U.S. states, territories, and military addresses (APO/FPO/DPO). International shipping may be available for certain orders at additional cost.
6.2 Delivery Timeline
We typically process and ship orders within 1-2 business days. Delivery times vary based on location and shipping method selected. We are not responsible for carrier delays.
6.3 Title and Risk of Loss
Title to Products passes to you upon delivery to the carrier. You assume all risk of loss or damage after delivery to the carrier.
6.4 Inspection
You should inspect all deliveries promptly. Report any issues, damages, or discrepancies within 7 days of receipt to hello@coffeetrial.com. Failure to report issues within this timeframe may constitute waiver of claims.
6.5 Delivery Issues
We are not liable for delays or failures due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, labor disputes, or carrier delays.
7. Returns, Exchanges, and Refunds
Our complete Return, Exchange, and Refund Policy is available at coffeetrial.com/returns and is incorporated into these Terms by reference. Key points include:
- Quality guarantee on all coffee products
- 30-day return window for unopened products
- Exchange options for damaged or incorrect items
- Refund processing times and methods
8. Licenses
8.1 Limited License to Use Service
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes.
8.2 License Restrictions
You may not:
- Reproduce, distribute, modify, or create derivative works of the Service;
- Reverse engineer or attempt to extract source code from the Service;
- Remove or alter any proprietary notices;
- Use the Service for any unlawful purpose or in violation of these Terms;
- Interfere with or circumvent any security features of the Service.
8.3 Feedback
If you provide feedback or suggestions about the Service, you grant us an unrestricted, perpetual, royalty-free right to use such feedback for any purpose.
9. Intellectual Property Rights
The Service and all Content are owned by TastePilot LLC or our licensors and are protected by copyright, trademark, and other intellectual property laws. All rights not expressly granted in these Terms are reserved.
The Coffee Trial name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of TastePilot LLC. You may not use such marks without our prior written permission.
10. User Content
10.1 Your Content
You retain ownership of content you submit to the Service ("User Content"), such as reviews, photos, or comments.
10.2 License to Use Your Content
By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free, perpetual license to use, reproduce, modify, distribute, and display your User Content in connection with the Service and our business, including for marketing and promotional purposes.
10.3 Content Standards
You represent and warrant that your User Content:
- Does not infringe any third-party rights;
- Is not false, misleading, or fraudulent;
- Does not contain viruses or malicious code;
- Does not violate any law or regulation;
- Is not defamatory, obscene, or offensive.
10.4 Content Removal
We may remove User Content that violates these Terms or is otherwise objectionable, without notice and at our sole discretion.
11. Prohibited Conduct
You agree not to:
- Use the Service for any illegal purpose or in violation of any laws;
- Violate or infringe any third-party rights;
- Interfere with or disrupt the Service or servers;
- Attempt to gain unauthorized access to any portion of the Service;
- Upload or transmit viruses or malicious code;
- Collect or harvest information about other users;
- Impersonate any person or entity;
- Engage in any fraudulent activity;
- Circumvent any security or authentication measures;
- Use automated systems or software to extract data from the Service;
- Resell or commercially exploit the Service without authorization;
- Create multiple accounts for abusive purposes;
- Harass, threaten, or intimidate other users.
12. Third-Party Services and Links
The Service may contain links to third-party websites or services. We are not responsible for the content, privacy policies, or practices of third-party sites. Your interactions with third parties are solely between you and such third parties.
13. Communications
13.1 Electronic Communications
By using the Service, you consent to receive electronic communications from us, including emails, text messages, and push notifications. You agree that electronic communications satisfy any legal requirement for written communications.
13.2 Marketing Communications
You may opt out of promotional communications by following the unsubscribe instructions in the communication or contacting us at hello@coffeetrial.com.
13.3 Text Messaging
If you opt in to text messaging, standard message and data rates may apply. Reply STOP to opt out of text messages.
14. Privacy
Your use of the Service is subject to our Privacy Policy, available at coffeetrial.com/privacy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices regarding your personal information.
15. Disclaimers and Warranties
THE SERVICE AND PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.
YOU ASSUME ALL RISKS RELATED TO THE HANDLING, PREPARATION, STORAGE, AND CONSUMPTION OF PRODUCTS. YOU ARE RESPONSIBLE FOR VERIFYING PRODUCT CONTENTS FOR ALLERGENS OR DIETARY RESTRICTIONS.
16. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL TASTEPILOT LLC OR ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE OR PRODUCTS.
OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $100.
THESE LIMITATIONS APPLY EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND EVEN IF ANY REMEDY FAILS OF ITS ESSENTIAL PURPOSE.
17. Dispute Resolution and Arbitration
17.1 Binding Arbitration
Except as described below, you and TastePilot LLC agree that any dispute arising out of or relating to these Terms or the Service will be resolved through binding individual arbitration, rather than in court.
17.2 Arbitration Rules
Arbitration will be conducted by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will be held in Albuquerque, New Mexico, or another mutually agreed location.
17.3 Exceptions
The following disputes are not subject to arbitration:
- Small claims court actions;
- Injunctive relief for intellectual property infringement;
- Disputes that cannot be arbitrated under applicable law.
17.4 Class Action Waiver
YOU AND TASTEPILOT LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS OR REPRESENTATIVE PROCEEDING.
17.5 Opt-Out
You may opt out of arbitration by sending written notice within 30 days of accepting these Terms to:

17.6 Arbitration Costs
For claims under $10,000, we will pay all arbitration filing fees. Each party will bear its own attorney's fees unless the arbitrator determines otherwise.
18. Indemnification
You agree to indemnify, defend, and hold harmless TastePilot LLC and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or related to:
- Your use or misuse of the Service or Products;
- Your violation of these Terms;
- Your violation of any third-party rights;
- Your User Content;
- Any dispute between you and another user.
19. Digital Millennium Copyright Act (DMCA)
We respect intellectual property rights and comply with the DMCA. If you believe content on our Service infringes your copyright, please send a DMCA notice to:

20. Modifications to Terms
We may modify these Terms at any time by posting revised Terms on our website. We will provide notice of material changes at least 7 days before they take effect. Your continued use of the Service after changes become effective constitutes acceptance of the modified Terms.
21. Termination
21.1 Termination by You
You may terminate your account at any time by contacting us at hello@coffeetrial.com.
21.2 Termination by Us
We may suspend or terminate your account or access to the Service at any time, with or without cause or notice. If we terminate your account, we will refund any prepaid but unused subscription fees.
21.3 Effect of Termination
Upon termination:
- Your right to use the Service immediately ceases;
- You must pay any outstanding amounts owed;
- Provisions that by their nature should survive termination will remain in effect.
22. General Provisions
22.1 Governing Law
These Terms are governed by the laws of the State of New Mexico, without regard to conflict of law principles.
22.2 Entire Agreement
These Terms, together with our Privacy Policy and other referenced policies, constitute the entire agreement between you and TastePilot LLC regarding the Service.
22.3 Severability
If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.
22.4 Waiver
Our failure to enforce any right or provision of these Terms will not be considered a waiver of such right or provision.
22.5 Assignment
You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
22.6 Force Majeure
We will not be liable for any delay or failure to perform due to causes beyond our reasonable control.

25. Notice Regarding Apple
If you access our Service through an iOS application:
- These Terms are between you and TastePilot LLC only, not Apple Inc.;
- Apple has no obligation to provide maintenance or support for the app;
- Apple is not responsible for any product warranties or liability claims;
- Apple and its subsidiaries are third-party beneficiaries of these Terms;
- You represent that you are not located in a country subject to U.S. embargo or designated as terrorist-supporting.
